Welcome to our Garden Maintenance Services in Waterloo. These Terms and Conditions outline the rules and guidelines for using our services. By engaging with us, you agree to comply with and be bound by the following terms.
1. Scope of Services
Our garden maintenance services include, but are not limited to:
- Regular lawn mowing and trimming
- Weeding and planting
- Pruning of shrubs and trees
- Garden bed maintenance
- Seasonal clean-ups
- Pest and disease management
Additional services may be provided upon request and subject to availability and additional charges.
2. Service Scheduling
Our maintenance schedules are typically weekly, bi-weekly, or monthly, depending on the client's needs and the garden's requirements. Specific scheduling agreements will be outlined in the service contract.
3. Payment Terms
Payments for our services are due as follows:
- Invoices are issued on a monthly basis.
- Payment is due within 30 days of the invoice date.
- We accept various payment methods, including bank transfers and major credit cards.
- Late payments may incur a 5% late fee per month.
All prices are subject to change with a 30-day notice to clients.
4. Client Responsibilities
Clients are expected to:
- Provide access to the property at agreed times.
- Ensure that garden areas are free from obstacles that could impede service delivery.
- Inform us of any known hazards or special instructions related to the garden.
- Maintain clear communication regarding any changes or specific requests.
5. Liability and Insurance
We maintain comprehensive liability insurance to cover any accidental damages caused during service delivery. However, clients are responsible for providing information about any existing garden structures or valuable items. We are not liable for:
- Pre-existing damages
- Damages caused by natural occurrences beyond our control
- Unauthorized alterations made by clients
Clients are encouraged to inform us of any fragile or valuable items in the garden prior to service commencement.
6. Termination of Services
Either party may terminate the service agreement with a 30-day written notice. Termination procedures are as follows:
- Provide written notice via email or certified mail.
- All outstanding payments must be settled within 15 days of termination.
- Final services will be rendered up to the termination date.
Immediate termination may occur in cases of severe breach of terms, negligence, or illegal activities.
7. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Clients will be notified of significant changes at least 30 days in advance. Continued use of our services after such notifications constitute acceptance of the updated terms.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the province of Ontario. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Waterloo.
9. Confidentiality
We are committed to maintaining the confidentiality of client information. Personal data collected during service delivery will be handled in accordance with applicable privacy laws and will not be shared with third parties without consent, except as required by law.
10. Force Majeure
We are not liable for any failure to perform our services due to causes beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, or governmental restrictions. In such events, services may be rescheduled or terminated without penalty.
11. Intellectual Property
All materials, including designs, plans, and any proprietary information provided by us, remain the intellectual property of our company. Clients are granted a limited license to use these materials solely for the purpose of garden maintenance services.
12. Indemnification
Clients agree to indemnify and hold harmless our company, its employees, and agents from any claims, damages, liabilities, and costs arising from the client’s misuse of our services or violation of these Terms and Conditions.
13. Dispute Resolution
In the event of a dispute, both parties agree to first seek resolution through informal negotiation. If unresolved, disputes will be mediated before pursuing legal action.
14. Entire Agreement
These Terms and Conditions constitute the entire agreement between the client and our company regarding garden maintenance services. No other terms, conditions, or agreements, verbal or written, shall have any effect unless signed by both parties.
15. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16. Assignment
Clients may not assign or transfer their rights or obligations under these Terms without our prior written consent. We reserve the right to assign our rights and obligations as necessary.
17. Notices
All notices under these Terms and Conditions must be in writing and will be deemed effectively given upon delivery when sent via email or certified mail to the addresses provided by the client and our company.
18. Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or the right to enforce it in the future.
19. Headings
Headings used in these Terms and Conditions are for reference purposes only and do not affect the interpretation of the provisions.
20. Acceptance
By engaging our garden maintenance services in Waterloo, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
